Surrogacy

Surrogacy

Modern science provides a solution to those couples who cannot have offspring. This method has long been used in the world as a treatment for infertility.

This topic is quite discussed in society. It is not surprising that it is overgrown with a series of myths, both biological and legal.

Correctly write - suragat or surrogate. In the ads, you can find references to the search for a suragat or surrogate mother. They also talk about surrogacy. The grammar is really worth doing. The word "surrogate" means a defective replacement. That is, this is a mother who simply replaces her own. Such a woman has nothing genetically to do with the fetus she carries.

A pregnant child will have the blood of a surrogate mother. The truth is that the circulatory systems of the surrogate mother and the fetus do not communicate with each other. So there is no blood connection between them that many professionals and researchers of this topic write about.

A child born by a surrogate mother will look like her. This will not happen unless, of course, this is actually her own child.

A surrogate mother, in fact, gives up her own child. This is a misconception that can only be realized with the introduction of a traditional surrogacy program. It is officially legalized in many countries, including the United States. There, a surrogate mother, she is also a reproductive person, acts as an egg donor. She is subjected to artificial insemination with the customer's sperm. And in the reproductive clinic it will be a surrogate mother, not an infertile married couple. In such a situation, according to the legislation in force in Russia, the names of the biological father (if he recognizes the fact of paternity) and the reproductive mother will be included in the birth certificate. But in Russia such a situation is impossible, so if such an option is proposed, then this indicates the incompetence of the party that provides the legal part.

The surrogate mother actually abandons the child in the hospital. You cannot give up what does not actually belong to you. At the birth of a child, the surrogate mother must immediately agree to record the names of the baby's biological parents in the birth book. This consent is usually given in writing and is confirmed by the seal of the hospital where the birth took place. The document is also signed by an authorized person.

The services of surrogate mothers can be used only by married couples. The Family Code of the Russian Federation establishes that legal marriage is only one of the conditions for making an entry about parents in the birth register at the registry office. You can draw an analogy with adoption - such a procedure is not allowed for persons who are not married. So for the use of a surrogate mother, a stamp in the passport is not needed, it will be required when registering a child at the registry office. If the parents are not officially married by that time, then the surrogate mother will be recorded as the mother in the documents. So you still have to sign, why not do it before starting such a responsible program. According to the laws of the Russian Federation, a single woman has every right to artificial insemination or implantation of a child. If she has a medical condition, then she can resort to the help of a surrogate mother to carry her baby. Then at birth it is the biological mother who will be recorded in the documents. And then the consent of the surrogate mother is required to make such a record.

A woman who already has at least two children can become a surrogate mother. The documents of the Ministry of Health of Russia indicate that a person with one child may well become a surrogate mother.

The surrogate mother has three days to decide to keep the baby. The law does not in any way establish the period during which a surrogate mother must give her consent to be recorded in the birth book of biological parents. This consent can be given at any time after delivery and before discharge. Usually this period is exactly three days. However, obtaining consent later will not prevent the child from being registered. According to the law, this must be done within a month after birth.

If the surrogate mother decides to keep her child, then all that remains is to put up with it. According to the law, it is possible to challenge not only paternity, but also maternity. Therefore, it is possible to challenge the entry in the birth book, though already in court. This process can be initiated by the person who is actually the father of the child. Here, numerous documents will be required from the side of lawyers who are involved in the legal support of surrogacy.

Surrogacy is inherently immoral and contrary to God's will. Even the Bible describes how two biblical characters, Abraham and Jacob, also used the services of surrogate mothers. Only not narrow-minded believers who have not even read the Bible can condemn such a process. God gave man the opportunity to multiply, including with the help of science.

Surrogacy is used by those who do not want to waste time carrying and damaging their figure. This statement is far from reality. In fact, women who either have serious pathologies of the uterus, or are absent altogether, and also if numerous attempts to get pregnant with IVF have failed, have to resort to this step. Turning to the services of a surrogate mother is not a reluctance to become pregnant, but, alas, her complete impossibility. Anyone who uses such services has actually faced great grief. And only with the help of surrogacy, a couple gets a chance to raise their own child. And don't think that this procedure is simple for biological parents. The very "conception" involves a rather aggressive intervention in the woman's body. And it is not known what this is fraught with in the future. That is why it makes no sense to talk about saving time or preserving the figure.

Surrogacy is very expensive. They say that for the services of a surrogate mother you have to pay with almost an apartment in Moscow. In fact, these statements look fantastic. The whole procedure, even with full support, will be much cheaper. And often surrogate mothers are offered to become relatives of their own free will.

Surrogacy is an illegal method. In 2011, the law “On the Fundamentals of Health Protection of Citizens of the Russian Federation” was adopted. It was actively discussed in the press, which increased the awareness of citizens. Naturally, surrogacy is a completely legal procedure, since even show business stars use it openly. And lawyers would not accompany an openly illegal case.

Surrogate mothers often keep the child for themselves. Legal regulations do allow a surrogate mother to keep a child. Indeed, in order to record the biological parents in the birth certificate, the consent of the surrogate mother is required. In theory, she may well not give her permission to do so. In practice, this happens very rarely. The whole procedure is based on a contract, which clearly sets out the rights and obligations of the parties. This allows you to respect the interests of all participants in the process. The agreement with the surrogate matter must also be certified by a notary. In fact, such notarization will not give the contract additional legal force. That is why such a step has no practical sense.

It is better not to resort to such a complicated procedure, but simply to adopt a child. Who among us does not dream of a dear baby who would take over our features, would be like grandparents. Adoption, on the other hand, means taking up a completely alien child, with someone else's set of genes that is different from the family. This is quite serious and not everyone can decide on such a step. So in this case, there is only one opportunity to prolong the birth - surrogacy.

If reproductive female indicators are normal, and age does not allow giving birth, then you will have to give up the dream of having a child. Today, age in itself is not a verdict. Women acquire children after 50 through surrogate motherhood. For such a procedure, the main thing is that at least one viable egg has matured in the body. You can also freeze biological material beforehand so that you can use it later. This is exactly what Alla Pugacheva did, her plan was successfully implemented.

It is risky to give birth even with the help of a surrogate mother after 40 years. And it is true. If the biological mother is already in anticipation of menopause, then the risk of giving birth to a child with abnormal development will be as high as when carrying it on its own. It is good that today there are prenatal diagnostic methods that allow you to recognize the genetic background of the embryo in time and identify violations.

Children born to a surrogate mother are different from those born naturally. This is not true, such children are no different from ordinary ones. On the contrary, doctors constantly monitor their health. Even in preparation for pregnancy, both biological parents and a surrogate mother are checked. The whole process of bearing a child and childbirth is under the close supervision of specialists, which only increases the chances of a healthy person.

For this procedure, a surrogate mother's egg can be used, not a biological one. In this case, the surrogate mother would give the child her genes, becoming his own. In cases where it is not possible to use the egg of a woman who has applied for help, then they resort to the services of a donor. The very idea of surrogate motherhood is that a childless couple has a child with a related set of genes. And the fertilization process here is similar to IVF. The biological mother is undergoing hormone therapy, which stimulates the maturation of the follicles. When they reach the desired size, a puncture is taken under general anesthesia. The taken ovum is fertilized with male embryos and after 3-5 days the embryos are transferred to the surrogate mother.
